The Lessee remains liable for final reclamation <br /> even past the expiration date of the Lease Term. If the Lessee requires access to the property <br /> or reclamation work after the expiration of this Lease, the Lessee must seek specific <br /> permission from the Board. <br /> (a) All holes shall be substantially, safely plugged per industry best practice and the <br /> requirements of DRMS. All holes shall be capped at all times when not in use. The planned <br /> method of plugging exploration holes shall be submitted for Board approval prior to use. <br /> (b) Reseeding any disturbed soil surface with suitable flora and restoring the terrain and soil <br /> surface to as close as reasonably practicable to their original condition as determined by <br /> the Board, and restoring all Leased Land disturbed by Lessee to a condition and forage <br /> density reasonably similar to its original condition and forage density, as determined by the <br /> Board; <br /> (c) Completing, as reasonably required, all leveling, terracing, seeding, mulching, and other <br /> reasonably necessary steps to prevent soil erosion, to ensure the establishment of suitable <br /> grasses and forbs, and to control noxious weeds and pests, as approved by Board. <br /> (d) Removing any personal property fixtures, equipment or improvements in a manner that <br /> minimizes injury to the Leased Land. At the option of the Board, acting in its sole <br /> discretion, Lessee shall forfeit ownership of any personal property, fixtures, equipment or <br /> improvements remaining on the Leased Land after expiration or termination of this Lease <br /> and shall not be entitled to any portion of the proceeds the Board may realize from the sale <br /> of such personal property, fixtures, equipment or improvements. <br /> (e) All materials brought into any area, such as paper, cans, wire, dynamite boxes and other <br /> refuse, shall be removed. <br /> (f) Upon the request of the Board, Lessee shall provide the Board with copies of any plans for <br /> restoration and reclamation. <br /> If Lessee fails to satisfy the requirements of this Section, the Board may do so, in which case <br /> Lessee shall reimburse the State Land Board for all reasonable costs of removal and restoration <br /> incurred by the Board.. <br /> 17. DATA - The Board shall be entitled to data obtained from exploration activities on Leased Land, <br /> including a log of each hole and information about the quantity and quality of minerals <br /> encountered, which data may be kept confidential upon request as permitted under state law. <br /> 18. HISTORICAL, PREHISTORICAL, AND ARCHAEOLOGICAL RESOURCES - Under no circumstances may <br /> any person injure, destroy, disturb, mar, appropriate, collect, remove, alter, or excavate any <br /> historical, prehistorical or archaeological site or resource on state lands. Discovery or <br /> indication of such a site or resource shall be immediately brought to the attention of the Board <br /> and the State Archaeologist. Lessee shall comply with the requirements of C.R.S. § 24-80-401 <br /> through 411, as same may be amended from time to time. <br /> 19. SPECIAL STIPULATIONS - Lessee shall comply with the following Special Stipulations: <br /> (a) Wildlife: The Lessee shall make all reasonable efforts to limit negative impacts on wildlife. <br /> The Lessee shall meet the following conditions: <br /> i. [None] <br /> (b) Conservation Reserve Program (CRP): 34.5 acres of the Leased Land is enrolled in the CRP. <br /> The Lessee is not permitted any access to the CRP area.
