or fuel usage,transfer or storage, an adequate spill kit and shovels are required to be onsite during <br /> project implementation. The project proponent will be responsible for adhering to all applicable <br /> local, state and federal regulations in the event of a spill. <br /> Soils <br /> Soils range from approximately 8-12 inches in depth with the average depth being ten inches. Soils <br /> are reddish-brown, and the surface layer lightly colored, with moderate permeability and a high <br /> percentage of float rock and stones. The proposed mining requires removal of vegetation along <br /> with underlying soil mantle and overlying material that results in alteration of the landscape in the <br /> area. A stormwater pollution prevention plan (SWPPP) would be prepared prior to mining in <br /> compliance with Section 402 of the Clean Water Act and would describe measures to minimize <br /> erosion and prevent soils from leaving each site during mining activities. The measures outlined <br /> in the SWPPP would stabilize disturbed areas during and after mining. During concurrent <br /> reclamation, portions of the disturbance area will be reclaimed with live-hauled topsoil and these <br /> areas would be reseeded. Upon final reclamation of the disturbance area and road,the surface will <br /> be recontoured and any stored topsoil will be redistributed. All areas will then be drill-seeded and <br /> mulched for vegetation success. Therefore, the proposed action and other alternatives will not <br /> create a potential significant impact to soil health. <br /> Environmental Justice <br /> An environmental justice screening was completed and based on U.S. Census Bureau American <br /> Community Survey (ACS) data as used by EPA's EJ Screen tool (U.S. EPA 2023; U.S. Census <br /> Bureau 2022), the percent of population (all ages) in poverty did meet the low-income threshold <br /> (using the criteria of 50 percent or more of the study area population or below 200 percent of the <br /> federal poverty level of the State of Colorado)to be identified as having potential EJ populations. <br /> Based upon these data sets, the U.S. Census block group surrounding the project area has low- <br /> income populations that meet the criteria for being identified as potential environmental justice <br /> populations.No minority or tribal concerns have been raised,and there are no known non-resident <br /> EJ populations that could be potentially affected. BLM has considered all input from persons or <br /> groups regardless of age, income status, race, or other social or economic characteristics.
