• The Native American Graves Protection and Repatriation Act of 1990(P.L. 101-601) <br /> • Executive Order 12898 of 1994, "Federal Actions to Address Environmental Justice in <br /> Minority Populations and Low-Income Populations" <br /> • The Paleontological Resources Protection Act of 2009 <br /> 1.5 Scoping and Identification of Issues <br /> The BLM Tres Rios Field Office conducted internal scoping to identify environmental issues and <br /> concerns associated with the proposed action. During the onsite inspection meeting on December <br /> 16, 2016, the BLM and applicant discussed potential impacts, mitigation measures, and design <br /> features to reduce impacts to visual resources, soil resources, deer and elk winter range, and <br /> vegetation resources. An additional onsite inspection with Dolores County was conducted on June <br /> 11, 2024 to define the area of expansion disturbance and discuss reclamation design features. A <br /> BLM interdisciplinary team(ID Team)meeting was held with BLM resource specialists on March <br /> 4, 2024 to finalize environmental issues for analysis. <br /> The BLM TRFO posted notice of the proposed action on BLM's ePlanning website on June 6, <br /> 2024 to notify the public of the Proposed Action. As a result of the posting,no comment letters on <br /> the Proposed Action were received by the BLM. <br /> The BLM initiated Native American consultation with the 26 Tribes and Pueblos that have cultural <br /> affiliations with the landscape managed by the Tres Rios Field Office on June 13,2024. An email <br /> from the Hopi Tribe was received on June 14th,2024 requesting consultation.A phone call on June <br /> 14th, 2024 between TRFO and the Hopi Tribe identified the Tribe's concerns regarding lack of <br /> royalties paid by the operator, the length of the contract, the acreage size of the contract, and the <br /> effect the pit would have on cultural resources in the area. On June 17th,2024,the TRFO provided <br /> additional cultural information to the Hopi Tribe, including a cultural survey and a map with <br /> buffered cultural locations,and requested a meeting to further discuss concerns. On July 8th,2024, <br /> the TRFO sent a subsequent follow up with additional pictures from the gravel pit and from the <br /> cultural sites in the area. <br /> CHAPTER 2 <br /> 2.0 PROPOSED ACTION AND ALTERNATIVES <br /> NEPA and its implementing regulations require that an agency rigorously explore and <br /> objectively evaluate a range of reasonable alternatives. Reasonable alternatives are those that <br /> meet the purpose and need for action and that are feasible to implement,taking into <br /> consideration regulatory,technical, economic, environmental, and other factors. This EA <br /> focuses on the proposed action and no action alternatives.
