Line Camp Pit <br /> M-2001-001 <br /> Page 2 of 3 <br /> STAFF RECOMMENDATIONS <br /> Violation(s): <br /> Find a violation pursuant to C.R.S. 34-32.5-116(4)(i)for-failure to protect areas outside of the affected <br /> land from slides or damages occurring during the mining operation. <br /> Corrective Action(s): <br /> The Operator shall be required to submit to DRMS a 112c permit amendment, complete for filing purposes, <br /> within 30 days of the mailing date of the signed MLRB Order and obtain DRMS approval of the application <br /> within the statutory deadlines. The submittedpermit amendment shall, at a minimum, include all affected <br /> acreage to date associated with the disturbance outside the permit area. <br /> Civil Penalties: <br /> In accordance with C.R.S. 34-32.5-124(7)an operator who violates any provision of a permit issued under <br /> this article shall be subject to a civil penalty of not less than one hundred dollars per day nor more than one <br /> thousand dollars per day for each day during which such violation occurs. In this instance, 82 days of <br /> penalty may be assessed from the date of the RTB to the date of September's MLRB hearing,giving a civil <br /> penalty range of$8,200 to$82,000. <br /> • In this matter the Division will assess a civil penalty in the amount of one hundred dollars($100) <br /> for 82 days of violation for a total of$8,200. With all but of$820.00 suspended if the Operator <br /> complies with the corrective action by the deadline specified. <br /> • The unsuspended portion of the civil penalty, $820, is due within 30 days of the effective date of <br /> the Board' s Order finding the violation which will be sent under a separate cover.
