Box 279 <br />Florence, CO 81226 <br /> <br />RE: Florence Sand & Gravel Pit - File No. M-1992-051, <br /> Amendment (AM-1) <br /> Request for an Amendment to add 4.92 acres to permitted area. <br /> <br />Dear Mike Langston: <br /> <br />On August 20, 2024, the Division of Reclamation, Mining and Safety received your 112c Construction <br />Materials Reclamation Permit Amendment application for the Florence Sand & Gravel Pit, which is located <br />in Fremont County. Preliminary review of the information received determined that the following <br />additional information must be received before the Division can consider your application complete and <br />technical review can begin. Thus, your application is incomplete for the purposes of filing as of September <br />3, 2024. <br /> <br />1) On the application form, item #5.1 Incidental commodities are given as stone, overburden, and sand. <br />Landscape stone and sand are already listed as primary commodities and will not be considered incidental <br />commodities. If the applicant intends to sell overburden material, please specify this in the response to item <br />#5.3 for the anticipated end use of inicidental commodities. If overburden is not going to be sold offsite and <br />will be used during reclamation of this operation, please remove all of the commodities listed under item #5.1 <br />and the response to item #5.3. <br /> <br />2) In the application form, item #9 Location Information for the center of where the majority of mining will <br />occur, the information provided of S20, T19 south, R69 west, in the NE quarter section is outside of the <br />permitted area. The currently disturbed area is in Section 21 of the NE quarter section while the future mining <br />area is in Section 20 of the SE quarter section. Please make the appropraite correction to the application form. <br /> <br />3) On the application form, item #9 Location Information under the General Description, the nearest town is <br />not included in the applicant’s response. Please include the nearest town on the application form. <br /> <br />You have sixty (60) days from September 3, 2024 to submit all necessary documents that the Division needs <br />for the application to be considered filed. If, at the end of the sixty day period, the application has not been <br />determined to be complete and filed, the Division may deny the application and terminate the application file. <br /> <br />This letter shall not be construed to mean that there are no other technical deficiencies in your application. <br />The Division will review your application to determine whether it is adequate to meet the requirements of <br />the Act after submittal of all required items.
