EVRAZ INC NA <br /> Page 2 of 4 <br /> The Lessee shall make the payments of rent due at the time and place and <br /> in the manner specified above. <br /> 2. Lessee is permitted use the water for commercial purposes at sand and <br /> gravel pit located in Section 21, Township 19, Range 69 North West in <br /> Fremont County,Colorado. <br /> 3. Lessor will maintain all dams, diversion ditches, headgates and other <br /> structures relating to the water to the point of the measuring devices. <br /> 4. Lessee will handle their own carriage of water shares and will report meter <br /> readings weekly to Lessor. If Lessee shall need access to the canal for <br /> water share carriage purposes, it is expected that the lessee will maintain <br /> easement, roads and access points as they were originally found. Faulting <br /> in this or causing damage to easements, roads or access points can lead to <br /> termination of this agreement. <br /> 5. Lessor accepts no liability for loss of water due to calls on the river or low <br /> water conditions. <br /> 6. The service of any notice provided for in this Lease shall be complete and <br /> effective on the date such notice is hand delivered, delivered by express <br /> courier, or placed in the United States mail, certified or registered, with <br /> return receipt requested, postage prepaid, and addressed to the respective <br /> parties as follows: <br /> LESSOR: CF&1 Steel,L.P. <br /> Attn: Leaha Zinanti <br /> P.O.
