BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE NOTICE BY OWL SWD OPERATING, LLC OF <br /> A FIRST PERIOD OF TEMPORARY CESSATION, File No. M-2008-070 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") as a <br /> consent item on June 20, 2024, to consider the notice of a first period of temporary <br /> cessation filed by OWL SWD Operating, LLC ("Operator"), file number M-2008-070. <br /> The Board, having considered the materials presented with this consent <br /> agenda item and having been otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c)-reclamation permit for a gravel operation. The <br /> site is known as the White River Pit, located in Rio Blanco County, Section 9, <br /> Township 1 North, Range 70 West, 6th Principal Meridian. <br /> 2. On April 2, 2024, Operator requested that the White River Pit be <br /> placed into Temporary Cessation status due to a lack of industry activity and <br /> economic justification for continued operation. <br /> 3. On April 3, 2024, the Division deemed the notice incomplete and <br /> informed Operator of what additional information was necessary. <br /> 4. On May 2, 2024, Operator provided the Division with the required <br /> information. <br /> 5. Operator has committed to comply with all reclamation requirements <br /> or other activities related to applicable performance standards while the mine is in <br /> temporary cessation. <br /> 6. The financial warranty is adequate to cover current reclamation. <br /> 7. The Division has identified no performance standard issues in the <br /> notice or through an inspection of the file for the site. <br /> 8. Division provided notice to all interested parties of Operator's notice, <br /> and no interested parties objected to or expressed concerns with the notice. <br />
