<br /> <br /> <br /> <br /> <br /> <br />August 12, 2024 <br /> <br /> <br />Alan Lincoln <br />Kiewit Infrastructure Co. <br />1550 Mike Fahey St <br />Omaha, NE 68102 <br /> <br /> <br />Re: Fountain Colony Pit - File No. M-1987-171 <br /> Kiewit Infrastructure Co. <br /> Surety Release Request (SL-1) <br /> Full / Final release of 24.7 acres <br /> <br />Dear Alan Lincoln: <br /> <br />On August 12, 2024 the Division of Reclamation, Mining and Safety concluded its review of the <br />Surety Release Request application submitted to the Division on July 25, 2024, addressing the <br />following: <br /> <br />Request for the full and final release of the remaining 24.7 acres <br /> <br />The decision reached by the Division is: Approve. <br /> <br />I am pleased to inform you that the Division of Reclamation Mining and Safety has determined that <br />Kiewit Infrastructure Co. is eligible for release from further responsibility for the Fountain Colony <br />Pit. In accordance with Rule 4.17.2(5), the Division is required to wait thirty (30) days from this <br />notice to allow for appeal of the Division’s decision.
