2024-2025 Chavers Mining Resources Substitute Water Supply Plan Page 5 of 8 <br /> July 25, 2024 <br /> a copy of the lease extension with the City of Aurora to this office by November 1, 2024 that includes <br /> adequate replacement water to replace all un-replaced depletions, after accounting for any transit <br /> losses. If this plan is not decreed in water court by the SWSP expiration date, a renewal request must <br /> be submitted to this office with the statutory fee of $257 no later than October 1, 2024 (or May 1, <br /> 2024 if extended). If a renewal request is received after the expiration date of this plan, it may be <br /> considered a request for a new SWSP and the $1,593 filing fee will apply. <br /> 2. During the plan period of August 1, 2024 through December 31, 2024 (or July 31, 2025 if the plan is <br /> extended), the above-described exposed surface area and depletion amounts for each use shall not be <br /> exceeded. <br /> 3. The Applicant must replace all out-of-priority depletions resulting from operation under this SWSP, <br /> including those lagged depletions that occur to the stream after the expiration date of this SWSP. <br /> 4. As part of any renewal of this SWSP, the Applicant must specify the proposed replacement source that <br /> will be used to replace all lagged depletions that result from operation under this SWSP, including those <br /> that extend beyond the approval period of the SWSP. If the intent is to obtain a short-term lease for <br /> such future replacement water an executed lease for depletions that extend beyond the SWSP approval <br /> period is not required, however the Applicant must demonstrate that there is a reasonable likelihood <br /> that such a lease could be obtained. <br /> 5. Approval of this SWSP is for the purposes as stated herein. This office must first approve any additional <br /> uses for the water. <br /> 6. All pumping for dust control shall be measured in a manner acceptable to the Division Engineer. <br /> 7. Well permit no. 80121-F was issued for the gravel pit site in accordance with sections 37-90-137(2) and <br /> (11), C.R.S. A new well permit must be obtained for the well in accordance with section 37-90- <br /> 137(2) and this SWSP since the proposed depletions and exposed groundwater surface area exceed <br /> the amounts permitted by permit no. 80121-F. Any application will be evaluated subsequent to <br /> approval of this SWSP. Application receipt no. 10036481 submitted on June 5,2024 is currently pending <br /> evaluation. The provisions of section 37-90-137(2), prohibit the issuance of a permit for a well to be <br /> located within 600 feet of any existing well, unless the State Engineer finds that circumstances so <br /> warrant after a hearing in accordance with the procedural rules in 2 CCR 402-5. The hearing will be <br /> waived if the Applicant is able to obtain statements from the owners of all wells within 600 feet, <br /> verifying that they have no objection to your use of the proposed well. <br /> 8. Well permit no. 80120-F (WDID 0206393) was issued in accordance with section 37-90-137(2), C.R.S. for <br /> the alluvial well used for the concrete production, and this permit remains valid. <br /> 9. The replacement water that is the subject of this SWSP cannot be sold or leased to any other entity. <br /> As a condition of subsequent renewals of this SWSP, the replacement water must be appurtenant to this <br /> site until a plan for augmentation is obtained. All replacement water must be concurrent with <br /> depletions in quantity, timing, and locations. <br /> 10. The Applicant shall provide daily accounting (including, but not limited to diversions, depletions, <br /> replacement sources,and river calls) on a monthly basis. The accounting must be uploaded to the CDSS <br /> Online Reporting Tool within 30 days of the end of the month for which the accounting applies <br /> (https://dwr.state.co.us/Tools/reporting). Instructions for using the tool are available on the Division <br /> of Water Resources website on the"Services" —> "Data Et Information"page under the heading of Online <br /> Data Submittal. Accounting and reporting procedures are subject to approval and modification by the <br /> division engineer.
