COLORADO
Division of Water Resources
Department of Natural Resources
July 25, 2024
Greg Geras
Land Resource Manager
Asphalt Specialties Co., Inc.
10100 Dallas Street
Henderson, CO 80640
Re: Chavers Mining Resources Substitute Water Supply Plan (WDID 0202654)
DRMS File No. M-2015-030 (0210488)
E 'h of the SW'/a of Section 18, Twp. 1N, Rng. 66W of the 6th P.M.
Water Division 1, Water Districts 2, Weld County
SWSP ID: 5057
Approval Period: August 1, 2024 through December 31, 2024 (or July 31, 2025 subject to
Condition No. 1)
Contact Information for Greg Geras: 303-289-8555 and GregG@asphaltspecialties.com
Dear Greg Geras:
This letter is in response to your June 3, 2024 substitute water supply plan ("SWSP") renewal request for a
sand and gravel pit operated by Asphalt Specialties Co., Inc. ("Asphalt Specialties" or "Applicant") in
accordance with section 37-90-137(11), C.R.S. The Applicant shall be responsible for compliance with this
SWSP, but the State Engineer's Office ("SEO") may also pursue the landowner for eventual compliance.
The original plan was approved on August 3, 2016 and was most recently renewed on August 29, 2023. The
required fee of$257 for the SWSP has been paid (receipt no. 10036421).
SWSP Operations
The Chavers Mining Resources site is located in the E 'h of the SW'/a, Section 18, Township 1 North, Range
66 West of the 6th P.M. (Figure 1, attached). The depletions that result from the mining operation over the
period of this SWSP include evaporation from exposed groundwater, dust suppression, dewatering, concrete
production, and water lost with the mined product. The life expectancy of the Chavers Mining Resources
site is approximately 10 to 12 years, with 3 to 5 years remaining. Approximately 650,000 tons are to be
excavated from the pit each year during the mining operation.
Mining operations will occurin Cells 2, 3, and 4 during this SWSP period. The site is actively being dewatered
to facilitate dry mining. The dewatering water is discharged into a sedimentation pond to settle out fines
and from there into another dewatering trench which discharges to the South Platte River as shown on
attached Figure 2. There is also a concrete production plant on Cell 1 at the site which utilizes groundwater
from the onsite alluvial well, permit no. 80120-F (WDID 0206393).
Well permit no. 80121-F was issued for the gravel pit site in accordance with sections 37-90-137(2) and
(11), C.R.S. A new well permit must be obtained for the well in accordance with section 37-90-137(2)
and this SWSP since the proposed depletions and exposed groundwater surface area exceed the
amounts permitted by permit no. 80121-F. An application currently is pending under receipt no.
10036481. Any application will be evaluated subsequent to approval of this SWSP. The provisions of section
37-90-137(2), prohibit the issuance of a permit for a well to be located within 600 feet of any existing well,
unless the State Engineer finds that circumstances so warrant after a hearing in accordance with the
OC010
1313 Sherman Street, Room 821, Denver, CO80203 P 303.866.3581 www.colorado.gov/water
Jared S. Polis, Governor I Dan Gibbs, Executive Director I Jason T. Ullmann, State Engineer/Director I p
*1R76`
