based on IBLA decision 94-366.
Coal processing waste generated at the wash plant facility is trucked approximately 3.6 miles to
the refuse disposal area located east of the rail loadout in the northeast portion of the permit area.
The refuse disposal area includes eleven subareas of refuse deposition. The first subarea (RP-1)
was reclaimed in late 1990, implementing a revegetation study that involved variations from the
required four feet of cover. Combined Refuse Area RP-2/3/4, the adjacent Refuse Area RP-5A,
and Refuse Area RP-A are currently active, and the remaining subareas have yet to be
developed. Non-coal solid wastes are hauled to an off-permit landfill by a contract trash service.
The on-site Halandras Landfill was retired and is no longer used for on-site non-coal waste
disposal.
Refuse and landfill areas, and degas well pads are reclaimed contemporaneously. Certain facility
areas used during initial mine construction have been reclaimed and a few additional facilities
will be reclaimed during the life of the operation if they no longer have operational utility. Most
surface area disturbance will not be reclaimed until all mining has ceased. Mine-related surface
disturbances to be reclaimed at that time include the D/B-Portal area facilities, water storage
area, overland conveyors, slot storage area, loadout area, and the alluvial well field/lagoon area
at Scullion Gulch. All permitted access roads and the refuse haul road will be reclaimed. All
light use roads will be reclaimed, with the exception of pre-existing roads used to access
exploration or de-gas drill sites, which BLM designates to be retained for post-mine use. With
the exception of the D/B-Portal area sediment pond, all sediment ponds controlling runoff from
various surface facilities will be retained until vegetation on reclaimed areas is sufficient to
control erosion. The D-Portal pond will be removed at the time of structural demolition and
regrading of the facilities area. Alternative sediment control measures will be employed for the
reclaimed facility area.
Reclamation of all surface disturbances will involve the sealing of all portals, the removal of all
surface structures, backfilling to approximate original contour, reestablishment of disturbed
drainage patterns, replacement of topsoil on regraded areas and the seeding and mulching of
those topsoiled areas. Seeded areas may be fertilized based on evaluation of specific fertility
tests of topsoiled areas.
Status of Previous Stipulations
Stipulation No. 1:
1A PRIOR TO ISSUANCE OF A PERMIT TO CONDUCT MINING OPERATIONS, THE
APPLICANT MUST: SUBMIT A PERFORMANCE BOND PAYABLE TO THE STATE
AND THE US GOVERNMENT IN AN AMOUNT CONSISTENT WITH THE
REQUIREMENTS OF (B) BELOW AND THE RECLAMATION COST ESTIMATES
CONTAINED IN THE APPLICATION.
Status: This stipulation was satisfied and terminated on July 27, 1981.
Stipulation No. 2:
vii
