A. Underground openings requiring sealing at the mine include mine portals, mine
shafts, groundwater monitoring wells, one alluvial water well, gas injection
boreholes, breathable air holes and vent degasification wells. The Division will
require that each hole, well, or other underground opening be capped, sealed,
backfilled, or otherwise properly managed(4.07.3).
VI. Use of Explosives—Rule 4.08
No specific approvals are granted to the applicant under this section.
VIL Disposal of Excess Spoil —Rule 4.09
No specific approvals are granted to the applicant under this section.
VIII. Coal Mine Waste Banks —Rule 4.10
Information pertaining to the handling and disposal of coal processing waste generated by
the mining operation is presented in Section IV.D Vol. 4 of the permit application.
Map 77 shows the RP-1 refuse pile,Map 77a shows the RP-5a refuse pile,Map 150 shows
the RP-2/3/4 refuse pile and Map 162 shows the RP-A refuse pile. Refuse areas RP-1,
RP-2/3/4, RP-5A and RP-A were developed during previous permit terms. Refuse area
RP-I has been reclaimed; RP-2/3/4, RP-5A and RP-A are currently active.
Detailed design plans have not been provided for proposed future refuse disposal
structures. Pursuant to Rule 2.05.3(8)(ii), detailed design plans will need to be provided
prior to initiation of construction of Refuse Area 5B, and subsequent refuse disposal
structures to be developed over the life of the mine.
IX. Coal Mine Waste - Rule 4.11
The following specific findings apply to the approved refuse disposal areas, RP-1, RP-
2/3/4, RP-5A, and RP-A.
A. The Division approved plans for use, construction and maintenance of a coal mine
waste disposal area. The approval was based on a demonstration that no groundwater
exists to a depth of at least 44 feet below the refuse area, and no springs or seeps are
known to exist in the area(4.10.1(1)).
B. The Division finds that an alternative sub-drainage system for the coal mine waste
area is not required to ensure the applicable static safety factor, stability of the fill,
and protection of the surface and ground water. This is due to the demonstrated lack
of groundwater in the coal mine waste area (4.10.3(5)).
C. The permittee has demonstrated, based on physical and chemical analyses of refuse
material and cover soil, and vegetation field trials, that the revegetation requirements
of 4.15 can be met with less than four feet of cover on the coal processing waste bank
xxxiii
