renew. to the event the Lessee fails to give such notice, the lease will terminate at <br /> the end of the renewal term without further notice to either part. Lessee retains the <br /> right to enter the property after termination to perform reclamation of the affected <br /> land, remove stockpiles, and no mining shall occur post termination. <br /> 4. LEASED PROPERTY TO BE MINED. The lessee will obtain a mining permit for certain <br /> property located within Bent County owned by Lessor. This lease relates solely and <br /> exclusively to the portion of this property in Bent County. Legal description NW <br /> SEC 35 TS 225 R49W Bent. <br /> S. OBLIGATIONS OF LESSEE UNDER THE TERMS OF THIS LEASE. <br /> a. The following shall be the obligation of the Lessee: <br /> i. The Lessee shall be responsible for providing the appropriate mining <br /> permit. <br /> i�. The Lessee shall be responsible to provide the appropriate <br /> reclamation bonding. <br /> The Lessee shall provide all labor, materials, and equipment to <br /> properly mine the property set forth herein. <br /> iv. The Lessee shall comply with all other local and/or State Health <br /> Department regulations for operation of a mining permit. <br /> V. The Lessee shall be obligated to mine the area in a safe and <br /> appropriate manner according to all local, state, and Federal <br /> regulations. <br /> vi. Lessee shall comply with all reclamation requirements as set forth in <br /> the mining permit and applicable law and rules at its sole expense. <br /> Reclamation shall take place as required during the term of the permit <br /> and this lease, as required by law and regulation as well as after the <br /> termination of the lease, if full compliance has not been met by <br /> termination. <br /> vii. Lessee shall be responsible for compliance with all applicable water <br /> laws relating to retainage of surface water caused by its excavation. <br /> 5. COMPENSATION. The Lessee hereby agrees to pay the Lessor <br /> Payments shall be made by the 201h of <br /> each month following the month the material is removed from the mining site. A <br /> monthly report accounting for all tonnage removed from the Property will be made <br /> available to the Lessor. <br /> 7. INDEMNIFICATION._The Lessee shall indemnify and hold harmless the Lessor from <br /> and against all liability, loss, damage, expense, fine or penalty, including but not <br /> limited to reasonable attorney's fees, caused by the negligence of the Lessee in <br /> 2 <br />
