EXHIBIT D <br /> MINING PLAN AND TIMETABLE <br /> LOCATION <br /> This is an open pit mine located approximately 12 .2 miles <br /> southwest of Creede, Colorado and west of Forest Service Road <br /> 528 . From Creede take HWY 149 6.25 miles south to County Road <br /> 523, then left on CR 523 for 4 . 0 miles to FSR 528 . Bear right <br /> on FRS 528 for 1 . 5 miles to the private road leading to the <br /> entrance of the mine at 37°43 '20 . 1728"N, 107°00 ' 49.23" . Mining <br /> access is via the existing private road. Soward Ranch, LLC, <br /> the owners use it to access their property to the south and <br /> west of the mine and it will remain after mining is complete <br /> for landowner access and the road is maintain during mining. <br /> Please refer to EXHIBIT B-VICINITY MAP for the property configura- <br /> tion and the relationships to surrounding land features . <br /> CURRENT CONDITIONS <br /> This an existing mine that has been in operation since <br /> 1988 . Map Exhibit C shows the outline of the existing permit area <br /> and the new Permit/Affected Lands boundary; the touching <br /> landowners; the 200 foot ownership; structures; current <br /> topography, and hydrologic features of the property. All <br /> surrounding property within 200 ft of the Permit line is owned <br /> by Soward Ranch, is primarily used as rangeland on all sides <br /> with Rio Grande River and river bottom lying along the western <br /> side. At this time the only permanent structures within 200 <br /> feet of the permit line are fences, a water well used on the <br /> ranch and 2 powerlines . <br /> Along the north, west and south sides of the terrace are <br /> steep slopes that are the transition area from the rangeland <br /> down to the river bottom. This face appears to have been <br /> created by past flood events on the Rio Grande River. It is <br /> marked by erosion channels where water has run off the <br /> rangeland into the river bottom. <br /> The site is currently used as rangeland and consists of a <br /> gravel terrace paralleling the eastern side of the Rio Grande <br /> River valley. The usable materials on this site ranges from 5 <br /> to 50+ feet deep. The natural face in the preceding paragraph <br /> will be left intact along the north, west and most of the south <br /> sides, creating a 15 to 25 feet deep basin with a nearly flat <br /> floor surrounded by 3h to lv slopes .
