r <br /> BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE REQUEST BY HOURGLASS SANDS, LLP FOR <br /> A SECOND PERIOD OF TEMPORARY CESSATION, File No. M-2006-007 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> April 17, 2024 to consider the request for a second period of Temporary Cessation <br /> filed by Hourglass Sands, LLP ("Operator"), file number M-2006-007. Hunter Ridley <br /> appeared on behalf of the Division of Reclamation, Mining and Safety ("Division").1 <br /> There was no appearance on behalf of Operator. <br /> The Board, having considered the materials and testimony presented with <br /> this matter and having been otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c) construction material reclamation permit for a <br /> site, known as the Jamadojin Sand Mine, located in El Paso County, Township 16 <br /> South, Range 62 West, Section 34, 6th Principal Meridian. <br /> 2. On February 7, 2024, the Division received Operator's notice <br /> requesting a second period of Temporary Cessation for the site. <br /> 3. The Division conducted an inspection of the site on March 19, 2024. <br /> The Division did not observe any violations or problems, and the financial warranty <br /> is adequate. <br /> 4. Operator has demonstrated a commitment to conduct mining <br /> operations by the end of the second period of Temporary Cessation. <br /> 5. The financial warranty is adequate to cover current reclamation. <br /> 6. The Division has identified no performance standard issues in the <br /> notice or through an inspection of the file for the site. <br /> 1 The Division was advisory staff to the Board, not a party, in this proceeding. <br />
