BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE REQUEST GOLD EAGLE MINING, INC. FOR <br /> AN EXTENSION TO COMPLETE FINAL RECLAMATION, File Nos. M- <br /> 1977-248, M-1977-297, M-1978-342 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> February 21, 2024, a hearing regarding the request for an extension to complete final <br /> reclamation filed by Gold Eagle Mining, Inc. ("Operator") for the C-JD-5, Burros <br /> Mine, and Ellison Mine, file numbers M-1977-248, M-1977-297, M-1978-342. Lucas <br /> West appeared on behalf of the Division of Reclamation, Mining and Safety <br /> ("Division"). Don Coram and Bob Larson appeared on behalf of Operator. <br /> The Board, having considered the presentations, testimony, and evidence of <br /> the Division' and Operator, and being fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds reclamation permits for three of uranium and <br /> vanadium mines, the C-JD-5, Burros Mine, and Ellison Mine. The sites are located <br /> in Montrose and San Miguel Counties, Township 44 North, Range 18 West, Section <br /> 30, 10th Principal Meridian. <br /> 2. On June 29, 2021, the Division notified Operator that the status for <br /> the sites had been administratively changed to "Permanent Cessation- Final <br /> Reclamation Status." The Division's notice stated that though Operator had <br /> provided notice of final reclamation on January 7, 2013, a court injunction against <br /> the Department of Energy had prevented activities on Department of Energy sites, <br /> including Operator's, from occurring. The injunction was dissolved on March 18, <br /> 2019. The Division informed Operator that final reclamation was to be completed <br /> by March 18, 2024. <br /> 3. On January 16, 2024, the Division received a request from Operator <br /> for an extension of the March 18, 2024 deadline. The Division set the request for a <br /> hearing at the Board's February 21-22, 2024 meeting. <br /> 1 The Division was advisory staff to the Board, not a party, in this proceeding. <br />
