Technical Revision for Stockpiling of Fill <br /> Miller Pit <br /> Schmidt Construction Company <br /> Permit:M-1982-112 <br /> Inspection Report on the Fill <br /> prepared for Schmidt Construction by: <br /> Mark A. Heffner,Ecologist and Reclamation Specialist <br /> Date of Inspection of the Material: June 3, 2024 <br /> Person who performed the inspection: Mark A. Heifner <br /> Introduction and Overview of TR: This technical revision is for the stockpiling of clean fill <br /> material which has already been done at the Miller Pit. This material was hauled in under an <br /> approved fill permit from Elbert County. However,the Miller Pit permittee, Schmidt Construction, <br /> was not notified of this action and the fill stockpile was discovered on February 20, 2024 during an <br /> inspection of the pit to gather information for the Annual Report for the Reclamation Permit. Thus <br /> this technical revision is for an action that has already occurred,but proper procedures were not <br /> followed. When the previous landowner sold the land to the current landowner apparently they were <br /> not told about the Reclamation Permit and as a result the new landowner simply proceeded under the <br /> assumption that everything that had anything to do with the gravel pit was completed. <br /> Schmidt Construction,the holder of the Miller Pit permit, has no issues, at this time, with the <br /> development plan proposed by the landowner as the development will have a complimentary impact <br /> on the actual area being reclaimed. This project does slow down the process of bringing the <br /> reclamation to a conclusion because the fill material pile is on land that is supposed to be reclaimed <br /> along with the rest of the pit floor. It could delay full reclamation of the pit floor by at least a couple <br /> of years. The rest of the reclamation is proceeding nicely. The area where the pile is located is <br /> proposed to become a community amenity for the people who will live in the development. The <br /> amenity has not been designed at this time,but Donna Barrentine,Project Manager with Atwell, an <br /> engineering firm in Greenwood Village, CO, said in an email the facility will contain trails through <br /> Page 1 of 11 <br />
