Mark A. Heifner
37 East Colorado Avenue • Denver,Colorado 80210-3105 • (303)777-3371 or(303)906-8096
June 28, 2024
RECEIVED
Joel Renfro ,iUN 28 2024
Division of Reclamation,Mining and Safety pf mt,A
Room 215IOW 1A®
1313 Sherman Street
Denver, CO 80203
RE: Technical Revision for the Miller Pit M-1982-112: Fill material located on Pit Floor
Dear Joel,
Included are two copies of this Technical Revision which addresses the stockpile of fill material the
landowner placed on the floor of the pit which is being reclaimed. As this was not a part of the
reclamation plan its presence needs to be addressed with regard to why it is there and what its final
disposition will be. This pit has a long history that, since about 10 years ago or thereabouts the land
ownership here has been a bit chaotic. But now the current landowner intends to put a housing
development mainly on adjacent land immediately east of the area being reclaimed. The disposition of the
floor of the pit will not be all that different from what it has been reclaimed for as it will mostly be Green
Space and a Community Amenity with trails, picnic areas, playground, and maybe a clubhouse and pool.
No houses will be built in the reclamation area as it is all well within the 100 year flood plain. In fact,
there are no definite plans for the pit floor; there are just the concepts shown in the PUD submitted to
Elbert County.
I signed the technical revision form because I was the only one that can confirm what I found. But that is
no secret as anybody who has examined the pile will agree that there is no evidence that there are any
foreign materials within the pile. I did do soil collections for chemical tests on the soil to see if there are
any chemical aspects of the soil that would limit its use as fill anywhere in the development. Those tests
are not yet back from the CSU Soil Testing Lab,but should be coming fairly soon. This is a very busy
time of the year for the Lab. I seriously doubt there is anything limiting, but it is good to be sure. I also
signed it because I am Schmidt's representative and have been for about the last 40 years.
If you have any questions please contact me.
Respectfully,
Mark A. Heifner
cc: Mahkayla Selby
Jeffrey Jacobi
Dan Chavez
