4. At the February 21, 2024 Board meeting, the Division provided
testimony regarding the sites, the background regarding the court injunction that
had prevented work at the sites, and stated that the Division supported an
extension of the deadline to October 1, 2024 to provide the Operator with another
construction season to complete final reclamation.
5. The Operator also provided testimony regarding the state of the sites.
Much of the reclamation is completed but further coordination with the Division
and the Department of Energy is necessary to complete the remaining reclamation
work.
CONCLUSIONS OF LAW
1. The Board has jurisdiction over this matter pursuant to the Mined
Land Reclamation Act, Article 32 of Title 34, C.R.S. ("Act").
2. Under section 34-32-116(7)(q), C.R.S., all reclamation of a site must be
completed within 5 years from the date an operator has notified the Board that it
has commenced final reclamation.
3. Section 34-32-112(7), C.R.S., provides that the Board may extend the
5-year period for completion of final reclamation upon a finding that additional time
is necessary.
