EXHIBIT A <br /> Legal Description <br /> The proposed permit area is a tract of land located approximately three miles north of the Town <br /> of Wellington in Larimer County, Colorado. The proposed permit area includes 56.4 acres. <br /> According to the Larimer County Assessor's Office, the permit area parcel is owned by William <br /> Hilgenberg of WH Property Holdings LLC. The applicant, Connell Resources, Inc. has a lease <br /> agreement and Legal Right to Enter for the purposes of mining construction materials (see <br /> Exhibit N, Source of Legal Right to Enter). The property is zoned 0-Open, which is intended to <br /> accommodate a wide range of development patterns. Mining and on-site processing in Larimer <br /> County are allowed in the Open zoning district by Special Review. The applicant has already <br /> conducted a Larimer County Special Review Permit pre-application meeting with Larimer <br /> County Community Development staff. <br /> Quarter, quarter section description of the proposed permit area: <br /> Primarily in the northwest quarter (NWl/a) of Section ten (10), Township Nine North (T9N), <br /> Range Sixty-Eight West (R68W) of the Sixth Principal Meridian (6th P.M.), Larimer County, <br /> State of Colorado. However, a small portion of the proposed permit area extends into the NEl/a of <br /> Section 10 and the southern half of Section 3, T9N, R68W of the 6th P.M. <br /> Latitude/Longitude of main entrance: <br /> The 5J Pit site entrance shall be onto Larimer County Road 5J. <br /> 40.76244°N <br /> -104.99228°W <br /> The main 5J Pit entrance will enter Larimer County Road (LCR) 5J from the southeast corner of <br /> the proposed permit area. <br /> Description of proposed permit boundary: <br /> The proposed 5J Pit permit boundary contains approximately 56.4 acres. The boundary is <br /> consistent with the parcel property line on the south, northwest and east sides. Although the <br /> proposed western permit boundary follows the parcel property line along the northwestern part <br /> of the site, on the southwestern part of the site the proposed permit boundary is located to <br /> exclude property owner infrastructure. <br /> Affected Land Boundary Definition <br /> Although the proposed permit acreage is approximately 56.4 acres, only about 40 acres are <br /> currently planned for mining. However, the affected land boundary essentially follows the <br /> permit boundary to allow for reclamation activities and future potential mining and processing <br /> operations. Areas not disturbed by mining may be disturbed by access roads, stockpiles, material <br /> processing, or backfilling and other reclamation related activities.
