Dedication of Water Rights to the <br /> Fredstrom Pit Substitute Water Supply Plan <br /> Golden Land Company, LLCM„ as the owner of 5/12ths interest in the Zweck &Turner Ditch, <br /> hereby affirm that a pro-irata share (as pro-rata is defined below) of said water rights will be <br /> dedicated solely to the Fredstrom Pit Substitute Water Supply Plan for as long as there are <br /> depletions at this gravel pit, until such time as another replacement source is obtained, or until <br /> the associated depletions are reduced requiring less water to be dedicated This dedication is <br /> subject to the terms & conditions of Paragraph 10 of the Purchase and Sale Agreement <br /> between Aggregate Industries-WCR, Inc & Golden Land Company, LLC dated March 13, 2018, <br /> which makes available for mining operations a pro-rata share of the water rights appurtenant to <br /> the property based on the ratio of mined acres to total farmable acres; the remaining pro-rata <br /> share of the water rights not used for mining may continue to be used for irrigation of the <br /> property.
