g COLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> June 13, 2024 <br /> Bill Tenore <br /> T Bone Stone, Inc. <br /> 2337 Emery St <br /> Longmont, CO 80501 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing <br /> T Bone Stone Quarry; Permit No. M-2004-030 <br /> Bill Tenore: <br /> On April 30, 2024, the Division of Reclamation, Mining and Safety (Division/DRMS) sent you a notice of <br /> financial warranty replacement. The notice informed you that BMO Bank (formerly known as Bank of <br /> the West) the currently held letter of credit *OOS (formerly ending in *112) for the T Bone Stone Quarry <br /> (M-1994-030) will expire on August 6, 2024. The letter instructed you to provide a substitute bond in <br /> the amount of $20,300.00 by June 6, 2024. To date the Division has not received a substitute or <br /> replacement bond of$20,300.00. <br /> The Division believes this is a violation of: <br /> • C.R.S. 34-32.5-117(6)(a) and Rule 4.1(7) for failure to maintain the required Financial Warranty <br /> in good standing for the entire life of any permit. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation <br /> Act for the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et seq., and have scheduled this <br /> matter to appear before the Mined Land Reclamation Board (MLRB/Board). <br /> A Formal Public Hearing before the Board has been scheduled during the July 17-18, 2024 Board <br /> meeting. The hearing will be held at 1313 Sherman Street, Room 318, Denver, Colorado, beginning at <br /> 9:00 a.m. on July 17 or as soon thereafter as the matter can be considered. In order to be considered at <br /> the hearing, all exhibits, materials and witness testimony you wish for the Board to consider must be <br /> submitted by 5:00 PM on July 5, 2024 via email to the MLRB Administrator, Camille M. Mojar at: <br /> Dnr drms mlrb-submittals@state.co.usDnr drms mlrb-submittals@state.co.us. <br /> If you have good cause not to appear in person you must submit a request to the MLRB to appear <br /> virtually (via ZOOM). To do so, please submit an email to the MLRB Administrator, no later than 5:00 <br /> PM on July 12, 2024 for Board consideration. If approved you will receive an authorization code to <br /> attend the meeting for this matter. Please note that only Parties and those who will be testifying may <br /> participate in the hearing.
