approved the calculation of that amount of credit. The volume of water pumped from <br /> Well No. Aug. 1 in a calendar year shall be limited to the volume of water available <br /> for pumping, which shall be calculated as: <br /> Pumping Availablec,,,rer,ryear= PCcunentyear+ (PC <br /> pnoryear-Actual Pumpingpmyear) <br /> Where, PC = pumping credit. <br /> Water recharged in year N shall generate pumping credits in year N and Year N+1 <br /> only if unused credits remain. Water recharged in year N may not create pumping <br /> credits for use in years subsequent to Year N + 1 unless approved by Court decree <br /> or Substitute Water Supply Plan. <br /> 12.D. Additional Wells: Additional wells required by the Applicants for use under <br /> this plan for augmentation must be obtained through the well permitting process of <br /> the office of the State Engineer. The Applicants must prove the need for the <br /> additional well by complete statement of purpose to accompany the well permit <br /> application. A copy of the statement and application must be provided to the <br /> objectors and the objectors shall have 15 days from the date of the Applicants' <br /> notice to provide the Division Engineer with comments regarding the Applicants' <br /> proposed additional well. <br /> 12.E. Measurement and Accounting: All diversions into the Recharge Pond and <br /> pumping of Well No. Aug. 1 will be measured. Appropriate records will be <br /> maintained and proper reporting and accounting will be performed to insure that <br /> Applicants' pumping does not exceed the amount of pumping credit generated by <br /> recharge. At a minimum, Applicant shall provide to the Division Engineer by <br /> November 15 of each year a summary of recharge and pumping amounts from the <br /> immediately preceding November 1 through October 31 period and a calculation of <br /> any excess pumping credit from that period that may be applied to the subsequent <br /> year's pumping. Upon request, the Applicants shall provide the objectors with <br /> copies of the accounting submitted to the Division Engineer for a given year. <br /> CONCLUSIONS OF LAW <br /> 13. Incorporation of Findings of Fact: The foregoing Findings of Fact are <br /> incorporated into these Conclusions of Law. <br /> 14. Jurisdiction: The Court has exclusive jurisdiction over the subject matter of <br /> this proceeding pursuant to C.R.S. § 37-92-203, and over all persons or entities <br /> affected hereby, whether they have appeared or not. <br /> 15.
