the reclamation estimate for SL-04 that the 1.2 acres associated with the light access road and discharge <br /> pipe were not bonded for when the New Horizon Mine permit was initially approved. Thus there are no <br /> reclamation funds to be Phase I, II and III released for the reclamation activities associated with the 1.2 <br /> acre light use road and discharge pipe. The applicant will be released from all reclamation liability for the <br /> 1.2 acres associated with the light use road and discharge pipe; however, no bond monies will be given <br /> back with this release for said 1.2 acres. The entire 1.2 acres for the Light use road and discharge pipe <br /> have been approved at the request of the landowners to remain as permanent post mining features. <br /> Any person with a valid legal interest which might be adversely affected by this proposed decision may <br /> request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br /> 3.03.2(6). Public notice of this proposed decision will be published twice in the San Miguel Basin Forum <br /> as soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty <br /> days of the day following the first publication in the San Miguel Basin Forum. If no hearing is requested <br /> within those thirty days,the Division's decision will become final. <br /> Permit Number C-2010-089 Page 9 of 12 <br />
