southwest corner of the permit area south of AA Road. The road was stable with no indications of <br /> erosional features. The discharge pipe under AA Road was in good condition and clear of <br /> obstructions. The inlet to the pipe is lined with riprap. The riprap was in good condition and no <br /> erosion was observed. The inlet to the pipe was stable. The outlet from the pipe was also lined with <br /> riprap. The outlet was stable and there were no indications of erosion. The riprap liner was in good <br /> repair. There were no off-site impacts observed. <br /> Summary and Conclusions <br /> Based upon a review of the mine permit,the applicant's bond release application, and site inspections,the <br /> Division finds that Elk Ridge Mining and Reclamation, LLC has completed backfilling, grading and <br /> drainage reestablishment at the New Horizon North Mine in accordance with the approved reclamation <br /> plan. <br /> PHASE II <br /> Phase II bond release was requested on 1.2 acres associated with an access road and a supporting <br /> discharge pipe under AA Road. The two structures are located in the southwestern part of the permit <br /> boundary. The two structures are approved to remain as permanent post mining features. The access <br /> road and discharge pipe are not subject to the vegetation and topsoil replacement requirements for <br /> Phase II release. The structures were supporting the post mining land uses of an access road and <br /> discharge pipe respectively. The structures were stable and functioning as designed. No off-site <br /> impacts had occurred. <br /> Summary and Conclusions <br /> Based upon a review of the mine permit,the applicant's bond release application, and site inspections,the <br /> Division finds that Elk Ridge Mining and Reclamation, LLC has replaced topsoil in accordance with the <br /> approved reclamation plan. Elk Ridge Mining and Reclamation,LLC has established the access road and <br /> discharge pipe which support the approved post mine land use.The Division finds that the reclaimed area <br /> subject to this bond release is not contributing suspended solids to streamflow or runoff outside the permit <br /> area in excess of premining levels or in excess of adjacent nonmined areas. <br /> PHASE III <br /> Phase III bond release was also requested on the 1.2 acres associated with an access road and a <br /> supporting discharge pipe under AA Road. The two structures are located in the southwestern part of <br /> the permit boundary. The two structures are approved to remain as permanent post mining features. <br /> The access road and discharge pipe are not subject to the vegetation requirements for Phase III release. <br /> The structures were supporting the post mining land uses of an access road and discharge pipe <br /> respectively. The discharge pipe and access road were functioning as approved and supported the post <br /> mining land uses of a discharge pipe and access road respectively.
