Exhibit H <br /> Page 3 <br /> State Species <br /> A total of six State-listed or special concern species were identified as potentially occurring within the Permit Area <br /> or potentially affected as a result of Kersey Mine implementation: <br /> • black-footed ferret(state endangered[SE]) • mountain plover(SC) <br /> • plains pocket gopher(state species of special concern [SC]) • ferruginous hawk(SC) <br /> • long-billed curlew (SC) • Western burrowing owl(state <br /> threatened[ST]) <br /> The desktop review and field assessment(Exhibit H-1)concluded that,based on the known range and the <br /> presence/absence of potentially suitable habitat,the potential for occurrence for these species exists within the <br /> Permit Area.Five active black-tailed prairie dog colonies, which provide habitat for black-footed ferrets and <br /> western burrowing owl,were recorded within and adjacent to the Permit Area.However,prairie dog colonies <br /> recorded during the field effort are not present in areas of black footed ferret remtroductions.Additionally,the <br /> prairie dog colonies observed are small m size and fragmented throughout the Permit Area and,therefore,are not <br /> ideal for potential future reintroductions of the black-footed ferret. Burrowing owls were observed within two of the <br /> prairie dog colonies during the field survey,including one at a nest site. <br /> CSC submitted a letter to the CPW Distnct Area Wildlife Manager regarding species of concern in the Permit Area <br /> to obtain additional information.Based on coordination with CPW on previous projects,CPW will provide <br /> comments once CPW receives the Use by Special Review notice from the Weld County Planning Department. <br /> The state-listed western burrowing owl occurs within the Permit Area (Exhibit H-1 and H-2). Other state-listed or <br /> species of special concern considered likely or possible to occur in the Permit Area include the long-billed curlew, <br /> mountain plover,ferruginous hawk,and plains pocket gopher,respectively.No known occurrences of the long- <br /> billed curlew, mountain plover,ferruginous hawk or plains pocket gopher within the Permit Area were identified <br /> during the desktop review or the field investigation. <br /> Migratory Birds <br /> As discussed above,one burrowing owl nest was identified within the Permit Area. Other migratory bird species <br /> observed in the Permit Area include northern harriers, a red-tailed hawk,and a number of common songbird <br /> species. <br /> Due to the potential for occurrence or known occurrences of these species,CSC will consult with USFWS and CPW <br /> to determine if and to what extent avoidance,minimization,or mitigation measures,if any,may be warranted. <br /> (b) Provide a description of seasonal use of the area. <br /> The Permit Area is located within privately owned property currently utilized for rangeland and oil&gas <br /> production.Virtually all portions of the Permit Area continue to be subject to year-round use by oil and gas- <br /> producing entities, pipeline service companies,and other utilities,as required.The Mine Plan has been developed in <br /> a manner that facilitates/accommodates simultaneous and ongoing oil and gas production,as well as appropriate <br /> consideration of existing and/or abandoned oil and gas features. <br /> Colorado Sand Company II,LLC <br /> Kersey Mine Construction Material Regular(112)Operation Reclamation Permit Application <br /> June 7,2024 <br />
