Exhibit E <br /> Page 4 <br /> (2) Rule 3.1.2:Reclaiming Substitute Land <br /> There is no"substitute land" involved with the Kersey Mine project. Therefore, CSC does not propose reclamation <br /> of such. The"affected area" is wholly contained within(and coincident with)the designated Permit Area. All <br /> "affected area"or area(s)of disturbance within the Permit Area are to be reclaimed in a manner consistent with the <br /> Reclamation Plan,as stated. <br /> (3) Rule 3.1.3: Time Limit and Phased Reclamation <br /> CSC acknowledges the obligation to complete all reclamation activities"with all reasonable diligence",and that <br /> "each phase of reclamation shall be completed within five(5)years from the date the Operator informs the Board or <br /> Office that such phase has commenced". <br /> As stated above(re: Item 1 -Rule 3.1.1: Establishing Post-Mining Use),under steady-state conditions,concurrent <br /> reclamation will be carried out(on an annual basis)for the full life-of-mine,to be followed by a five-year post- <br /> reclamation monitoring and maintenance period to ensure that vegetation and stabilization objectives are achieved. <br /> Terminal pit reclamation and site facilities and infrastructure demolition and removal are proposed to occur <br /> immediately following cessation of mining(and processing)activities;those areas, as well,will be subject to the <br /> five-year post-reclamation monitoring and maintenance plan. <br /> (4) Rule 3.1.4:Public Use <br /> All lands incorporated into the Permit Area are owned fee-simple by Wells Ranch and as such, are private property. <br /> The ranch holdings, in the pre-mining condition,are maintained as private property with no right of public access,as <br /> evidenced by the presence of a controlled-access site entry,perimeter fencing,and other locked/gated points of <br /> access.CSC presumes that Wells Ranch LLC will continue to restrict public uses. <br /> (a) Where applicable,plans for topsoil segregation,preservation,and replacement for stabilization,compaction, <br /> and grading of spoil;and for revegetation. The revegetation plan shall contain a list of the preferred species <br /> of grass,legumes,forbs,shrubs or trees to be planted,the method and rates of seeding and planting,the <br /> estimated availability of viable seeds in sufficient quantities of the species proposed to be used,and the <br /> proposed time of seeding and planting. <br /> As discussed in Exhibit D: Mining Plan,initial site development will encompass the pre-stripping and temporary <br /> stockpiling of an anticipated nominal 12-inch "growth medium"horizon from the plant area footprint at a location <br /> south of the plant area, and within the western portion of the Year 7 mine block(e.g., TS-0). This would be followed <br /> by plant construction and concurrent pit initialization within the Year 1 mine block box cut in order to <br /> simultaneously secure sufficient run-of mine(ROM)material(to initiate processing shakedown operations and <br /> commissioning)while establishing sufficient pit void to accommodate both the long-term growth medium stockpile <br /> (TS-1)and the PDS. <br /> Due to the anticipated duration each stockpile would remain in place(up to 7 years for TS-0 and up to full life-of- <br /> mine for TS-1), stabilization at each stockpile location would employ vegetative cover(s)generally consistent with <br /> the seed mix depicted in Table E-2, below,as well as ongoing routine monitoring and maintenance for the duration <br /> of operations and/or until each stockpile is eliminated(through recovery for concurrent reclamation activities).
