Cunningham, Director <br />June 7, 2024 <br /> <br />Fremont County Commissioners <br />County Commissioner <br />615 Macon Avenue, Room B-5 <br />Cañon City, CO 81212 <br /> <br /> <br />Re: Southfield Mine (Permit No. C-1981-014) <br /> Bond Release Application No. 5 (SL-5) <br /> <br /> <br />Dear Fremont County Commissioners: <br /> <br />This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation, <br />Mining and Safety has issued a proposed decision to approve Bond Release Application No. 5 for <br />the Southfield Mine. This decision will be published in the Cañon City Daily Record as soon as <br />possible. The first day following publication of the notice initiates a thirty (30) day public comment <br />period. If, within thirty days, there are no requests for an adjudicatory hearing, the decision will <br />become final. <br /> <br />SL-05 is a Phase III Bond Release and termination of the Division’s jurisdiction for the revoked <br />Southfield Mine. This decision constitutes a full release of reclamation liability for the Southfield <br />Mine. Pursuant to Rule 3.03.3(1), the Division is proposing to terminate its jurisdiction over this <br />entire coal mining operation. <br /> <br />As an interested party, you have the right to an adjudicatory hearing as outlined under Rule <br />3.03.2(6) of the Rules and Regulations. The request for an adjudicatory hearing must be written <br />and state with specificity the reasons why the hearing is requested. The request must be received <br />within thirty days of the day following the first publication of the proposed decision in the Cañon <br />City Daily Record. <br /> <br />Copies of the proposed decision and findings are available for review at <br />https://dnrweblink.state.co.us/drms/search.aspx by searching C1981014 in the “Permit No” field. <br />A user guide is available to help first time users of the imaged document system and can be viewed <br />at https://drive.google.com/file/d/1l8OUdf_Mpjo3kxIHkP5hMH-w7MeBtxX7/view..
