creosote was encountered. Covenant allowance of this MRA excavation became a matter of contention <br /> with Butala,EPA and CDPHE and has led to a pending reevaluation of the contamination of OU2. <br /> Butala's MRA excavation was found to be in violation of their 1998 Reclamation Permit and a <br /> settlement was reached and so ordered by the Mined Land Reclamation Board(August 2023). Butala is <br /> committed to restrictions,current and future, as required by the EPA and CDPHE concerning the MRA <br /> and BA.The MRA and BA will continue to be used for stockpiling of products.These agency <br /> restrictions will govern mining limitations under this permit application. <br /> Future Mining <br /> Future mining per this application for permit amendment will continue in each pit with another 25-foot <br /> depth of excavation. The South pit will be mined first by continuing the excavation from the current pit <br /> floor. The North pit floor is currently used for stockpiles and will not be mined immediately.No <br /> overburden removal will be necessary for either pit. <br /> Mining will affect up to the full pit floor area with excavation,processing and stockpiling. Actual <br /> excavation typically involves two acres at a time with digging,hauling and surge stacking.Excavation <br /> will start at the lower(SW) end of the South pit due to drainage and proceed across the area. For the <br /> North pit,excavation will start on the west side and proceed across the area. <br /> Mining Plan <br /> Currently, approximately 3,100 linear feet of hanging wall exists along the north, east and south <br /> perimeters of the South Pit. The heights vary from 20' to 25'. The north perimeter is approximately <br /> 1,900'long and is presently being re-sloped at 2:1 for half the 25' height. This work should be <br /> completed by July 2024. The remaining north wall height will be sloped prior to mining deeper <br /> along the north perimeter(2027-28). The 800' east perimeter wall is scheduled to be sloped to 2:1 <br /> by the end on 2024 as the east end of the South Pit is expanded. The remaining 400' of hanging wall <br /> on the south perimeter will be sloped in 2026 as the South Pit is mined deeper in that area. <br /> Existing perimeter walls in the North Pit are sloped to 2:1. The Mine Restricted Area (MRA) has <br /> some partial vertical walls where Buffer Areas were excavated to a depth of 20'in anticipation of <br /> continuing the excavation int the MRA. The MRA walls are being filled to a 2:1 slope with clean <br /> excess mined material. This process is scheduled to be completed in 2025. Future walls will be <br /> sloped as mining takes place. <br /> Exhibit D-1 represents mining activity planned for the remainder of 2024. This includes sloping <br /> walls, expanding the South Pit to the east& south and smoothing the existing pit floor. Also, <br /> preparation for mining deeper in the South Pit requires installation of new drainage. Elevations <br /> allow for approximately 20'vertical fall for gravity drainage by installing a pipe onto TECK <br /> property at the NE cornet of the OU1 containment area. The outlet will be piped and ditched to the <br /> wash plant settling ponds. The South Pit will be excavated to the inlet depth and cutoff ditches will <br /> be constructed to direct seep water to the new outlet. The existing and new pit floors will be sloped <br /> for sheet runoff to the new outlet. Hydrologist forecast flows were used to design the outflow pipe <br /> at 30" diameter. <br />
