17. Post-Delivery Reclamation Responsibilities: Contractor shall remain <br /> responsible for compliance with all the terms and conditions of the Permits. <br /> Upon execution of this Construction Agreement, no amendment shall be made to <br /> any mining or reclamation plan, or any special or conditional use permit without <br /> Owner's prior written approval. Contractor will obtain Owner's written approval <br /> prior to the release of any reclamation bond, which approval will not be <br /> unreasonably withheld. <br /> a. Contractors Access to the Property for Reclamation Purposes. <br /> Contractor will be permitted to enter and have access to the Property for <br /> purposes of complying with and completing any reclamation or other post mining <br /> work necessary under the Permits after the Delivery Date. In performing any <br /> reclamation or post mining work necessary under the Permits, Contractor shall <br /> not destroy, damage, or injure the Property or any improvements on the <br /> Property. <br /> 18. Insurance. So long as it has not been released from the bonds and obligations <br /> under the Permits, Contractor shall procure and maintain in force, at its own cost, <br /> the following coverages: <br /> a. Workers' Compensation Insurance as required by the Labor Code of the <br /> State of Colorado and Employers Liability Insurance. <br /> b. Commercial General Liability Insurance with minimum combined single <br /> limits of Five Million Dollars ($5,000,000.00) each occurrence and Five Million <br /> Dollars ($5,000,000.00) general aggregate, with such policy to be applicable to <br /> all premises and operations, including coverage for bodily injury, broad form <br /> property damage (including completed operations), personal injury (including <br /> coverage for contractual and employee acts), blanket contractual, independent <br /> contractors, products, and completed operations, and also including coverage for <br /> explosion, collapse, and underground hazards. <br /> C. Automobile Liability Insurance with minimum combined single limits for <br /> bodily injury and property damage of not less than One Million Dollars <br /> ($1,000,000.00) for any one occurrence, with respect to each of Contractor's <br /> owned, hired or non-owned vehicles assigned to or used in performance of the <br /> Construction Agreement, reclamation or other post mining work necessary under <br /> the Permits. <br /> d. Contractor shall procure and maintain, and shall cause any Subcontractor <br /> of Contractor to procure and maintain, the minimum insurance coverages listed <br /> herein. Such coverages shall be procured and maintained with forms and <br /> insurers acceptable to Owner.
