Davis <br /> WSI Weiland, Inc. <br /> 525 3`d Avenue, Suite 211 <br /> Longmont, Colorado 80501 <br /> Dear Mr. Davis: <br /> We are responding to your letter of February 3, 2006, requesting project review under the <br /> authority conferred to the U.S. Fish and Wildlife Service (Service)by the Endangered Species <br /> Act of 1973 (ESA), as amended(16 U.S.C. 1531 et seq.). The Service has reviewed the updated <br /> plans for the Stroh Pit in Larimer County, Colorado, in regard to potential impacts to the <br /> Preble's meadow jumping mouse, Zapus hudsonius preblei (Preble's). <br /> The current plan is for 300-foot wide buffer zone between the Big Thompson River and the area <br /> to be mined. An exception to the 300-foot setback is a small area in the northwestern portion of <br /> the property where access will be afforded along existing roads and disturbed areas adjacent to a <br /> home site. We request that prior to finalization of a plan for planting trees, shrubs, and <br /> herbaceous vegetation within the buffer area, a site visit be coordinated with Mike Sherman of <br /> the Colorado Division of Wildlife to obtain his input on the plan. <br /> Based on the information provided, the Service agrees that while a population of Preble's is <br /> likely to be present within the project area,project plans avoid impact to Preble's or Preble's <br /> habitat. Therefore,the Service concludes that the proposed project on this site should not have <br /> adverse affects to Preble's. Please note that if additional information regarding listed or <br /> proposed species becomes available, this determination may be reconsidered under the ESA. <br />
