BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF REQUEST FOR EXTENSION FOR CONSIDERATION OF <br /> THE PERMIT AMENDMENT APPLICATION OF ASPHALT SPECIALTIES CO. <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> February 21, 2024, as a consent agenda item for a request for an extension of the <br /> deadline for consideration of the permit amendment filed by Asphalt Specialties Co. <br /> ("Applicant"), file number M-2015-030. <br /> The Board, having considered the materials presented with this consent <br /> agenda item and being otherwise fully informed of the facts in the matter, enters <br /> the following: <br /> FINDINGS OF FACT <br /> 1. Applicant has a 112(c) permit for a sand and gravel operation located <br /> in Section 18, Township 1 North, Range 66 West, 6ch P.M. in Weld County, for a site <br /> known as the Chavers Mining Resource. <br /> 2. Applicant filed a permit amendment application on February 2, 2023 <br /> ("AM2"). <br /> 3. The 365-day review period expired on February 3, 2024. <br /> 4. Applicant has requested a 90-day extension beyond the February 3, <br /> 2024, deadline to May 2, 2024, to allow it to work with the Division to address the <br /> remaining concerns with application packet. <br /> 5. The Division does not oppose Operator's request for an extension but <br /> supports an extension of 60 days, up to and including April 3, 2024. <br /> CONCLUSIONS OF LAW <br /> 6. The Board has jurisdiction over this matter pursuant to the Colorado <br /> Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br /> Title 34, C.R.S. (2023). <br />
