BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE NOTICE BY THE DENVER BRICK COMPANY <br /> OF A FIRST PERIOD OF TEMPORARY CESSATION, File No. M-1976- <br /> 007UG <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") as a <br /> consent item on February 21, 2024, to consider the notice of a first period of <br /> temporary cessation filed by The Denver Brick Company ("Operator"), file number M- <br /> 1976-007UG <br /> The Board, having considered the materials presented with this consent <br /> agenda item and having been otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c)-reclamation permit for a clay operation. The <br /> site is known as the Golden Mine. The site is located in Jefferson County, Section <br /> 16, T3N, R70W, 6th P.M. <br /> 2. On January 17, 2024, Operator requested that the Golden Mine be <br /> placed into Temporary Cessation status to allow Operator to pursue additional <br /> required permitting with Jefferson County. <br /> 3. Operator requested a cessation period starting January 11, 2024, until <br /> approval of the Zone Change in Jefferson County. <br /> 4. Operator has committed to comply with all reclamation requirements <br /> or other activities related to applicable performance standards while the mine is in <br /> temporary cessation. <br /> 5. The financial warranty is adequate to cover current reclamation. <br /> 6. The Division has identified no performance standard issues in the <br /> notice or through an inspection of the file for the site. <br /> 7. Division provided notice to all interested parties of Operator's notice, <br /> and no interested parties objected to or expressed concerns with the notice. <br />
