CONCLUSIONS OF LAW <br /> 14. The Board has jurisdiction over this matter pursuant to the Colorado <br /> Mined Land Reclamation Act, Article 32 of Title 34, C.R.S. (2024) ("Act"). <br /> ORDER <br /> Based on the foregoing findings of fact and conclusions of law, the Board <br /> hereby GRANTS a 365-day extension for Grand Island Resources, LLC to submit a <br /> designated mining operation application for the site. The DMO Application shall be <br /> filed no later than January 17, 2025. No extensions of time to file the DMO <br /> Application will be granted. Should Operator fail to comply with the January 17, <br /> 2025 deadline, the life of the mine shall be ended and Operator must begin final <br /> reclamation in accordance with all applicable rules. <br /> If the DMO Application is timely filed by January 17, 2025, but does not <br /> obtain approval from the Division within the statutory time limit, no additional <br /> time for Division consideration of the DMO Application will be granted and the life <br /> of the mine shall be ended and Operator must begin final reclamation in accordance <br /> with all applicable rules. <br /> DONE AND ORDERED this_11 day of April 2024. <br /> FOR THE COLORADO MINED LAND <br /> RECLAMATION BOARD <br /> Nell Wareham- orris, Chair <br /> NOTICE OF JUDICIAL REVIEW RIGHTS <br /> This order becomes effective and final upon mailing.
