BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF A REQUEST BY GRAND ISLAND RESOURCES, LLC, TO <br /> EXTEND THE DEADLINE TO SUBMIT DMO APPLICATION, File No. M-1977-410 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> January 17, 2024, to consider a request by Grand Island Resources, LLC ("Operator"), <br /> to extend the deadline for it to file a Designated Mining Operation ("DMO") <br /> application, File No. M-1977-410. Patrick Lennberg and Jared Ebert appeared on <br /> behalf of the Division of Reclamation, Mining and Safety ("Division"). Daniel Takami, <br /> Sergio Riveria, and Je'an-Paul Brewer appeared on behalf of the Operator. <br /> The Board, having considered the parties' presentations, testimony, and the <br /> administrative record, and being otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. The Operator holds a 110(2) reclamation permit for an 9.99 acre gold, <br /> silver, zinc, copper, and lead mine located in Section 9, Township 1 South, Range 73 <br /> West, 6th Principal Meridian in Boulder County, Colorado, permit number M-1977- <br /> 410. The permitted site, known as the Cross Gold Mine, is located outside <br /> Nederland, Colorado. <br /> 2. The site was the subject of hearings and a Board Order, effective <br /> February 18, 2022, which found Operator in violation of section 34-32-116(7)(g), <br /> C.R.S. and Rule 3.1.6(1) and required Operator to complete corrective actions. <br /> Operator has since completed all corrective actions. <br /> 3. On Feb 17, 2022, the Division notified Operator of its determination <br /> that the site was a Designated Mining Operation (DMO). <br /> 4. On March 18, 2022, Operator appealed the Division's DMO <br /> determination. <br /> 5. On June 13, 2022, the Division issued its final determination that <br /> the operation was a DMO. <br /> 1 <br />
