COLORADO <br /> Division of Reclamation, <br /> ® Mining and Safety <br /> Department of Natural Resources <br /> March 29, 2024 <br /> Marcus Mortensen <br /> Mortensen's Landscape and Irrigation <br /> 5868 CR 106 South <br /> Alamosa, Colorado 81101 <br /> RE: Peat Mine, Permit No. M-1994-081, Incomplete Application for Transfer of Mineral Permit <br /> and Succession of Operators, Revision SO-02 <br /> Dear Mr. Mortensen, <br /> On March 13, 2024 the Division of Reclamation, Mining and Safety received the Application <br /> Form for Transfer of Mineral Permit and Succession of Operators from Mortensen's Landscape & <br /> Irrigation, for the Peat Mine, Permit M-1994-081. The following items are incomplete for the <br /> application to be processed: <br /> 1. Application Fee: The currently permitted Peat Mine, M-1994-081, is a 112c operation. The <br /> application fee for a construction materials site is $144.00. A check for $115.00 was received <br /> with the application. Please submit a check for the remaining $29.00. <br /> 2. Financial Warranty: A bond in the amount of$12,017.00 is required along with a completed <br /> Financial Warranty form. This can be found on DRMS's website or Sara Stevenson-Benn can <br /> provide via email. <br /> 3. Performance Warranty: All blanks for Operator should read "Mortensen's Landscape & <br /> Irrigation LLC". No other iteration of the company's name is acceptable. For example, the <br /> notary wrote "Mortensen's Landscaping & Irrigation". This is not acceptable. <br /> 4. Affidavit of Authority: This can be found on DRMS's website or Sara Stevenson-Benn can <br /> provide via email. It should be signed by Marcus Mortensen then notarized. <br /> 5. Succession of Operators application form: All references to the Operator/Prospective <br /> Successor must read "Mortensen's Landscape & Irrigation LLC;" page 10 contained the same <br /> notary error described above. Marcus Mortensen must sign page 9 again and have notarized. In <br /> addition, Ronald Barrier's notary inserted her own name rather than his name; this invalidates <br /> the notary signature. Ronald Barrier must resign and have page 9 notarized. I can accept <br /> counterpart signatures so Mr. Barrier and Mr. Mortensen don't have to sign the same page 9. <br /> 6. Structure Agreements: No structure agreements were submitted with the application by the <br /> Prospective Applicant. The Prospective Applicant must notify any structure owners within 200 <br /> feet of the affected boundary of the permit.
