NCCI Bennett Gravel Pit SWSP Page 3 of 5 <br /> March 15, 2024 <br /> this operation will accrue to the South Platte River in the NE '/a of Section 12, Township 2 North, Range <br /> 66 West, 6th P.M. <br /> Replacements <br /> Out-of-priority depletions associated with the mining operation at this site will be replaced using fully <br /> consumable water from the City of Fort Lupton ("City"). The fully consumable water will be released to <br /> the South Platte River and will consist of fully consumable effluent from the City's Wastewater Treatment <br /> Plant ("WWTP") (WDID 0201017) resulting from Fort Lupton's potable use of Windy Gap Units, or release <br /> of fully consumable water stored in Perry Pit. The attached Figure 2 shows the location of the WWTP and <br /> Perry Pit and the distances in miles to the Bennett pit. Transit losses are estimated to be 0.5 percent <br /> per mile but are determined at the discretion of the Division Engineer. The lease provides 23.5 acre-feet <br /> of replacement water from March 1, 2024 through February 28, 2025, therefore this SWSP will expire on <br /> February 28, 2025. <br /> Conditions of Approval <br /> I hereby approve the proposed SWSP in accordance with section 37-90-137(11), C.R.S. subject to the <br /> following conditions: <br /> 1. This SWSP is approved with the effective date of March 1, 2024 and shall be valid through February <br /> 28, 2025 unless otherwise revoked or superseded by a decree. If this plan is not decreed in water <br /> court by the SWSP expiration date, a renewal request must be submitted to this office with the <br /> statutory fee of $257 no later than January 1, 2025. If a renewal request is received after the <br /> expiration date of this plan, it may be considered a request for a new SWSP, in which case a $1,593 <br /> filing fee will apply. <br /> 2. Well Permit 83515-F has been issued for this pit, and this permit remains valid. The permit allows <br /> the use of groundwater for pond evaporation, dewatering, dust suppression, and water lost with <br /> mined product. The permit allows for up to 11.0 acres of exposed surface area. The average annual <br /> amount of groundwater to be appropriated shall not exceed 93.1 acre-feet. Actual depletions cannot <br /> exceed these amounts and are limited to those uses specifically approved through this SWSP. <br /> 3. The Applicant must replace all out-of-priority depletions from operation under this SWSP, including <br /> those lagged depletions and return flow obligations that occur to the stream after the expiration <br /> date of this SWSP. If the intent is to obtain a short-term lease for such future replacement water an <br /> executed lease for depletions that extend beyond the SWSP approval period is not required, however <br /> the Applicant must demonstrate that there is a reasonable likelihood that such a lease could be <br /> obtained. <br /> 4. The total surface area of the groundwater exposed outside of the lined area must not exceed 0.85 <br /> acres, resulting in 2.34 acre-feet per year of evaporative loss. <br /> 5. The annual water used for dust control at the Bennett Pit site shall not exceed 9.6 acre-feet, and <br /> the total amount of groundwater used for washing the aggregate shall not exceed 11 acre-feet. <br /> 6. The total lagged depletions for this SWSP period from previous evaporation, operational losses and <br /> current dust suppression are limited to 22.1 acre-feet. <br /> 7. All pumping for dust control shall be measured in a manner acceptable to the Division Engineer. <br /> 8. Total consumption at the Bennett Pit site must not exceed these aforementioned amounts unless <br /> an amendment is made to this SWSP. The Applicant should consider the effects of groundwater <br /> mounding and the need for interceptor drains due to construction of the liners around the pits. <br />
