disturbed before or after the passage of the Surface Mining Control and <br /> Reclamation Act of 1977. Revegetation success criteria are described in detail in <br /> Exhibit 2.05-E6 of the PAP, and are based on either: (i) a determination that <br /> revegetation is unnecessary for erosion control and is not required; (ii) an estimate <br /> of total live vegetative cover required to control erosion derived from the Revised <br /> Universal Soil Loss Equation (RUSLE); or(iii) comparison of vegetative cover, <br /> production and species diversity with an extended reference area. <br /> The Division proposes to approve the basis for this comparison. <br /> E. The Division proposes to approve of the reference areas, which the applicant has <br /> selected based on the requirements of Rule 4.15.7(3). <br /> F. The reference areas will be utilized to determine revegetation success in a manner <br /> which the Division finds acceptable 4.15.7(4). <br /> G. The Division proposes to waive the woody plant density standard based on the <br /> requests of the landowners, as recorded in letters attached to Exhibit 2.05-E6 of the <br /> PAP [4.15.8(3) and (4)]. <br /> H. The Division proposes to waive the requirement to establish vegetative cover on an <br /> area containing mine support facilities where the approved post-mining land use is <br /> "Industrial or Commercial" since the waiver was requested by the landowner and <br /> the Division has determined that revegetation is not necessary to control erosion <br /> [4.15.10(3)]. <br /> XII. Post-mining Land Use <br /> A. The post-mining land use for most of the permit area is Undeveloped Lands which <br /> will be utilized for very limited grazing, dispersed wildlife habitat, and recreational <br /> uses. The land-use is consistent with the pre-mining land use. <br /> Several parcels within the disturbed area have been approved for a post-mining <br /> land use of"Industrial or Commercial", these parcels are shown on Map 2.05-M8 <br /> (sheets 1 and 2) of the PAP. The land use meets the criteria of Rule 4.16.3. <br /> XIII. Protection of Fish, Wildlife and Related Environmental Values <br /> A. Undeveloped lands is the planned post-mining land use for the majority of the <br /> permit area. The applicant has selected appropriate plant species and distributions <br /> to benefit fish and wildlife [4.18(5)(i)]. <br /> XIV. Protection of Underground Mining <br /> 32 <br />
