o Culvert DB <br /> o A 170' section of the Elk Creek Culvert <br /> A portion of the Elk Creek Mine Facilities area achieved Phase I bond release with SL-1 and <br /> Phase II bond release with SL-5, but the polygon included was truncated due to discrepancies <br /> between the actual topography of the reclaimed area and that depicted on Map 2.05-M6, Sheet 3 <br /> of 6 at the south end of the upper section of the reclaimed Elk Creek channel. For the remainder <br /> of the area to be eligible for bond release: <br /> i. The inconsistencies in the PAP must be addressed. Sections 2.05.4 and 2.05.5 of <br /> the PAP must be retained for now, but sentences should be added referring to the <br /> alternative land use described in Exhibit 2.05-E-5 and shown on Maps 2.05-M6 <br /> and 2.05-M8. The maps should show all features that are proposed to remain as <br /> permanent structures in support of the alternative land use. <br /> ii. The area must be graded to the approved post-mining topography, as shown on <br /> Map 2.05-M6. In this case it will likely be necessary to update Map 2.05-M6 <br /> with a Technical Revision. <br /> iii. When it can be demonstrated that the disturbed area is supporting its approved <br /> post-mining land use, a Phase I, II and III bond release application should be <br /> submitted. (Note that facilities still in use for any activity related to Mining and <br /> Reclamation will not be eligible for bond release; therefore, all mine-related <br /> equipment and materials must be removed from the area.) <br /> (h) Hubbard Creek Fan-site (Page 2.05-65) <br /> The reclamation of this area was completed in 2011. The area received Phase I and II bond <br /> release with SL-2, and Phase III bond release with SL-4, with a post-mining land use of <br /> "Undeveloped lands". <br /> The only work remaining to be done is to reclaim Pond F. <br /> (i) Coal Mine Refuse Piles (Page 2.05-65a) <br /> The three refuse piles have all been designed and constructed as permanent structures, and <br /> continuously reclaimed, in accordance with the reclamation plan. <br /> The West Valley Fill and II-West Valley Fill received Phase I bond release with SL-2 and Phase <br /> II bond release with SL-5. <br /> The East Yard Fill received Phase I, II and III bond release with SL-5. <br /> 0) Roads and Powerlines (Page 2.05-65a) <br /> Section 2.05.4 of the PAP specifies that the following major road segments will be retained: <br /> • Affected segments of Bear Creek, Lower Hubbard Creek, and Upper Hubbard <br /> Creek roads <br /> 16 <br />
