The Operator also <br /> consents to a Cease and Desist Order, Corrective Actions, and Civil Penalties provided herein, <br /> for the Cresson Project, Permit No. M-1980-244. <br /> Chronology: <br /> • February 4, 2024—Date of non-complaint ore stacking in VLF2 Phase 3A <br /> • February 6, 2024—Operator verbally notifies DRMS of an ore stacking event <br /> • February 8, 2024—Web call and Operator's presentation on ore stacking event <br /> • February 8, 2024—Follow-up web call and Operator's presentation on ore stacking event <br /> • February 15, 2024—RTB signed and mailed to Operator <br /> • February 26, 2024—Web call and Operator's presentation on corrective action plan <br /> Reason for Violation: <br /> On February 6, 2024, the Operator notified DRMS that on February 4, 2024, while stacking ore <br /> in Cell 6 of Valley Leach Facility 2 (VLF2)Phase 3A, ore spilled downhill into Cell 5. Through <br /> the Division's investigation into this notification, it became apparent that ore was placed in a <br /> downhill direction onto Drain Cover Fill (DCF) overlying the facility's geomembrane and clay <br /> liners. This action is in direct violation of the Permit, specifically Technical Revision 103 <br /> regarding the approved procedures of ore stacking which state when ore is being placed directly <br /> over the DCF,the material should always be placed in an uphill direction.
