The Division has <br /> reviewed the revised application materials that were submitted and deemed the information deficient. Please provide the <br /> following information for the Division's review: <br /> • Per Rule 5.1.2(d)(vi),documentation of legal right to enter is necessary prior to approval of the NOI from the Division. <br /> Based upon the provided information in the application, the proposed activities are located on CO State Land Board <br /> (SLB) and U.S. Bureau of Land Management (BLM) surface. As stated in the application, the Prospector holds an <br /> exploration permit from the SLB for the associated area. However,the documentation for legal right to enter was not <br /> provided within the application. Additionally, Prospectors will need to obtain a NOI or POO (Plan of Operation) <br /> approval from the BLM to satisfy this rule. The NOI with the Division only grants the right to the requested minerals <br /> but not the right to remove those minerals. <br /> • Per Rule 5.1.3(a), [flor activities on BLM or USFS lands,the twenty(20)working day period begins with the Office <br /> has received notification from the appropriate federal land management agency that they have receive the notice of <br /> proposed activities, or the Office has otherwise determined that the appropriate federal land management agency has <br /> received the notice. As part of the application,a copy of a Certified Mail Receipt addressed to the BLM Little Snake <br /> Office was provided. However,the receipt is not signed showing the application was received. In order to satisfy this <br /> Rule,the Division requires evidence of notification in which the Certified Mail Receipt will need to be formally signed <br /> by BLM. A letter or email from the appropriate BLM field office which references the proposed project is also enough <br /> to satisfy the Division's requirement. <br /> • In reviewing the materials submitted, no bonding has been provided with the Maybell Uranium Exploration Project <br /> application.Per Rule 5.3.3(1),upon filing the Notice of Intent to Conduct Exploration,the person shall provide Financial <br /> Warranty in the amount of two thousand dollars($2,000.00)per acre of the land to be disturbed,or such other amount <br /> as determined by the Office,based on the projected costs of reclamation. This amount acts as a placeholder bond until <br /> the Division can determine whether additional bond is required.
