Cunningham (Acting), Director <br />January 31, 2024 <br /> <br /> <br />Office of Archaeology & Historic Preservation <br />History Colorado Center <br />1200 Broadway <br />Denver, CO 80203 <br /> <br /> <br />Re: New Horizon Mine (Permit No. C-1981-008) <br /> Technical Revision No. 108 (TR-108) <br /> TR-108 Incidental Permit Boundary & PMT Revision <br /> <br /> <br />Dear Sir or Madam: <br /> <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on January 31, 2024 an <br />application to revise coal mining operations at the New Horizon Mine was considered complete for <br />the purposes of filing. The revision was submitted by Elk Ridge Mining and Reclamation, LLC. All <br />review and comment periods as provided in the Act and the Regulations initiate from this date of <br />filing. <br /> <br />TR-108 proposes to revise the post-mine topography on the Johnson Property, and reduces the permit <br />boundary to removed Phase III released structures from the permit boundary. The applicant is not <br />proposing additional surface disturbance outside of the area currently approved for disturbance. <br /> <br />The surface coal mining operation is on land located approximately 1.7 miles Northwest of Nucla, <br />Colorado. The permit area is further described as follows: <br /> <br />All or portions of the following: <br /> Sec 6, T46N, R15W: NE 1/4 NE ¼; W ½ NW ¼ NE ¼; SE ¼; <br /> <br /> Sec 1, T46N, R16W: N ½ NE ¼ NE ¼; NW ¼ NE ¼; NW ¼ SE ¼ NE ¼; <br /> NE ¼ NW ¼; N ½ SE ¼ NW ¼ <br /> Sec 36, T47N, R16W: SE ¼ <br /> <br /> <br />The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle <br />map(s): Nucla.
