Cunningham (Acting), Director January 31, 2024 Colorado Parks and Wildlife 2300 South Townsend Ave Montrose, CO 81401 Re: New Horizon Mine (Permit No. C-1981-008) Technical Revision No. 108 (TR-108) TR-108 Incidental Permit Boundary & PMT Revision Dear Sir or Madam: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on January 31, 2024 an application to revise coal mining operations at the New Horizon Mine was considered complete for the purposes of filing. The revision was submitted by Elk Ridge Mining and Reclamation, LLC. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. TR-108 proposes to revise the post-mine topography on the Johnson Property, and reduces the permit boundary to removed Phase III released structures from the permit boundary. The applicant is not proposing additional surface disturbance outside of the area currently approved for disturbance. The surface coal mining operation is on land located approximately 1.7 miles Northwest of Nucla, Colorado.
