Property or by any use or occupancy which Contractor may permit or <br /> suffer to be made of the Seller Retained Property or any injury to person <br /> or persons occurring on or about the Seller Retained Property; <br /> C. Contractor agrees, at Contractor's expense to keep in good working <br /> condition all fencing, buildings, wells, well fixtures, pumps, lawns, trees, <br /> shrubbery and all other improvements. Contractor also agrees to keep in <br /> good working condition all appliances, electrical and mechanical, owned <br /> by Thornton and located on the Seller Retained Premises; <br /> D. Contractor agrees, at Contractor's expense to maintain all buildings and <br /> improvements in as good a condition as they existed at the time of <br /> execution of this Construction Agreement; and <br /> E. Contractor agrees that the Seller Retained Property shall be included and <br /> covered by the terms of this Construction Agreement, including but not <br /> limited to the insurance and indemnification provisions in paragraph <br /> numbers 18 and 19 of this Construction Agreement. <br /> 9. General Reservoir Requirements and Design Specification: The parties <br /> agree to the following requirements and specifications, which are to be <br /> undertaken during the course of Contractors mining activities: <br /> A. General Requirements and Specifications. <br /> i. . Upon or before the execution of this Construction Agreement, Contractor <br /> shall provide to Owner a copy of the following: <br /> a) An ALTA survey of the Property. <br /> b) Division of Minerals and Geology (DMG) Permit, all revisions and <br /> amendments to the permit and all correspondence with the DMG. <br /> c) Agreements and permits with or from any governmental agency, <br /> special district, private individual, or corporation that may impact, restrict, or <br /> otherwise effect the use of the property. <br /> d) Mining Plan and Reclamation Plan that includes the proposed final <br /> configuration of the Reservoir, interconnects, and all other items that are or <br /> will be contained on or within the Property to be purchased by the Owner. <br /> ii. Contractor shall continue to provide to Owner, until Delivery Date copies <br /> of the following: <br /> a) All correspondence with the DMG. <br /> b) New agreements and permits or modifications to existing <br /> agreements and permits with or from any governmental agency, special <br /> district, private individual, or corporation that may impact, restrict, or <br /> otherwise effect the use of the Property or Storage volume of the Reservoir. <br /> Construction Agreement—Zadel(v.4-24-08) <br />
