Enclosed is the Division's decision form and written findings. The proposed <br />decision will be published in the Delta County Independent, as soon as possible. The first day <br />following publication of the notice initiates a thirty-day public comment period. If there are no <br />requests for an adjudicatory hearing within the thirty days, the decision will become final. <br /> <br />With the approval of SL-16, Mountain Coal Company is released from phase II reclamation <br />liability for 14.63 acres of disturbance, including the spreading of topsoil on the pads and roads <br />associated with 20 Mine Ventilation Boreholes (MVBs) and four exploration holes. The <br />reclamation was completed in 2016 and 2017. As provided by Rule 3.03.2(6), should you object <br />to the Division's proposed decision, you may request an adjudicatory hearing. <br /> <br />If you have questions or are in need of additional information, please contact me. <br />
