® COLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> December 7, 2023 <br /> Pat Farr <br /> K & B Mining, LLC <br /> 2601 Willow Park <br /> Richland Hills,TX 76118 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing; <br /> Badger a Group of Mines; Notice of Intent to Conduct Prospecting(NOI) No. P-2013-019 <br /> Mr. Farr: <br /> On February 9, 2023, the Mined Land Reclamation Board (Board/MLRB) issued their Findings of Fact, <br /> Conclusions of Law, and Order (Order) for Violation No. PV-2022-001. This Order included required <br /> corrective actions for K & B Mining, LLC (Operator) to A) within 180 days of the effective date of this <br /> Order, demonstrate the legal right to enter across private land and obtain a new Plan of Operations from <br /> the U.S. Forest Service to complete reclamation at the site and B) Within 180 days of the effective date <br /> of this Order, complete reclamation. <br /> As of the date of this letter, the Operator has not demonstrated the legal right to enter, obtained a Plan <br /> of Operations or completed reclamation. Additionally, the Operator has yet to submit payment of the <br /> unsuspended portion of the civil penalty, $1,000.00. Therefore the Division believes the Operator has <br /> failed to comply with the Board's order. <br /> The Division believes this is a violation of: <br /> ■ C.R.S. 34-32-124 for failure to comply with the conditions of an order, permit, or regulation. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation <br /> Act for Hard Rock, Metal, and Designated Mining Operations, C.R.S. § 34-32-101 et seg., and the <br /> provisions of your NOI No. P-2013-019, and has scheduled this matter to appear before the Board. <br /> A Formal Public Hearing before the Board has been scheduled during the January 17-18, 2024 Board <br /> meeting. The hearing will be held at 1313 Sherman Street, Room 318, Denver, Colorado, beginning at <br /> 9:00 a.m. on January 17 or as soon thereafter as the matter can be considered.
