Introduction <br /> This document is the proposed decision of the Colorado Division of Reclamation,Mining and Safety (the <br /> Division) in response to a request for Phase I, II, and III bond release at the Hayden Gulch Loadout <br /> (HGLO), Division file number C-1992-081. The package contains three parts. These include: 1) <br /> procedures and summary of the bond release process; 2) criteria and schedule for bond release and <br /> observations and findings of the Division regarding compliance with the bond release requirements of the <br /> Colorado Surface Coal Mining and Reclamation Act and regulations promulgated thereunder; and 3)the <br /> Division's proposed decision on the request for bond release. <br /> Detailed information about the review process can be found in the Act and the Regulations of the Colorado <br /> Mined Land Reclamation Board for Coal Mining. All Rules referenced within this document are <br /> contained within the Regulations. Detailed information about the mining and reclamation operations can <br /> be found in the permit application on file at the Division offices, located at 1313 Sherman Street, Room <br /> 215,in Denver, Colorado. <br /> The Hayden Gulch Loadout is a loadout which is permitted and operated by Hayden Gulch Terminal,LLC <br /> (HGT). The HGLO permit includes 391. 20 acres, of which 3 84.4 have been Phase III bond released as of <br /> this approval of SL-03. Coal was handled and shipped from this facility through 1987. The last active use <br /> of the facility was temporary coal storage in 1992. The loadout facilities were removed, and received a <br /> bond release from the Division with SL-01 in September of 2012. The former rail spur area was converted <br /> to a recreational trail for the use of residents and visitors to the town of Hayden under a locally managed" <br /> Tracks to Trails" program and was Phase III released from the Division with SL-02 in 2022. <br /> SL-03 was submitted to the Division on September 5, 2023 and requested release of 214.1 total acres <br /> which include the TAHR and the TAHR corridor. The ownership of the land for which bond release has <br /> been requested is state and private, and the coal ownership was federal, state and private. The reclaimed <br /> area encompasses 214.1 acres, of which 96.6 acres of land was disturbed and is occupied by a Tie Across <br /> Haul road(TAHR)and several permanent topsoil stockpiles located in the TAHR corridor. The remaining <br /> 117.5 acres have a post mining land use of cropland, livestock grazing, and wildlife habitat. These areas <br /> have not been disturbed throughout the life of the mine. HGT submitted a Technical revision, TR-12, in <br /> November 2022 requesting the TAHR remain as a permanent feature, consistent with the post mining land <br /> use of industrial/commercial established in PR-02. Routt County Road and Bridge provided HGT with a <br /> letter of intent to take over the TAHR, adding it to the public road system as a County Road once released <br /> by the Division. HGT will not be releasing the TAHR to Routt County until the proposed SL-03 bond <br /> release has been issued by the Division and after the comment period has ended on the proposed decision. <br /> The last page of this report shows the PAP approved Tab 20 Exhibit 20-1 post mining land use map for <br /> reference. The area proposed to be released in SL-03 is shown in orange and labelled as Future County <br /> Road. Following the approval of SL-03, the only remaining unreleased area at HGLO will be 6.8 acres, <br /> 2.3 of which are disturbed.
