(:blue earth <br /> SOLUTIONS <br /> December 6, 2023 <br /> Colorado Department of Natural Resources <br /> Division of Reclamation, Mining and Safety <br /> Attn: Ms. Hunter Ridley <br /> 1313 Sherman Street; Room 215 <br /> Denver Colorado, 80203 <br /> RE: Response to Adequacy Review Comments for City of Greeley <br /> 25"Avenue Site, Permit No. M-2002-020 <br /> Dear Ms. Ridley: <br /> The following discussion and attachments are submitted on behalf of our client, City of Greeley, <br /> in response to Adequacy Review comments prepared by the Division of Reclamation,Mining and <br /> Safety (the Division) dated October 16, 2023, for the 25th Avenue Site (M-2002-020) Technical <br /> Revision No. 3. The information and discussion below address each comment as it was presented <br /> by the Division: <br /> 1. The final design plan set for the Poudre Ponds Bank Stabilization Project is attached. The plan <br /> set is signed and stamped by a Colorado Licensed Professional Engineer who, in so doing, <br /> takes legal responsibility and liability for the design. The Professional Engineer stamp also <br /> suggests that the design includes current specifications, guidelines and standards that protect <br /> public health, safety and welfare. <br /> More specifically, on Sheet G3 under General Notes,reference is made to the use of Mile High <br /> Flood District standard specifications. In addition, the project required obtaining a Floodplain <br /> Development Permit from the City of Greeley. Obtaining the permit required hydraulic <br /> analyses consistent with the Federal Emergency Management Agency jurisdictional floodplain <br /> mapping standards. These analyses were also an intricate part of the stabilization design. <br /> 2. The attached Poudre Ponds Stabilization Project plan set (Otak, Inc. November 2023) is <br /> included as supplemental information within the Technical Revision No. 3 submittal. <br /> However, since TR-3 provides a revision to the current 25th Avenue Site Regular 112 <br /> Reclamation Permit, the applicant considers the design plan and construction to be part of the <br /> final reclamation plan. <br /> Blue Earth Solutions, LLC P.O.
