EXHIBIT K — CLIMATE <br /> Western Equipment & Truck Mine # 1 <br /> Western Equipment &Truck Mine # 1 is in the piedmont region of Colorado,whose localized <br /> topography is defined by level to rolling prairie interspersed by occasional hills and bluffs. It receives <br /> direct climatological influence from the front range of the Rocky Mountains, located West of the site. <br /> In general,the state of Colorado's interior continental location in the middle latitudes, high elevation, <br /> and mountain chains all have localized impacts on temperatures,wind patterns and storm tracks in all <br /> seasons of the year. <br /> Due to Colorado's middle latitude locale,there are large daily and seasonal temperature swings. <br /> Colorado's continental position -far from any large bodies of water- results in a generally dry climate. <br /> Therefore, Colorado typically has hot summers and cold winters with relatively large temperature <br /> differences throughout each day. <br /> Within the piedmont region, average wind movement is less when compared to the open plains of the <br /> eastern part of the state. However, areas closest to the foothills of the mountains are subject to <br /> periodic, severe turbulent winds from the effects of high westerly winds over the mountain barrier. <br /> These winds are sometimes referred to as "chinook winds" when they warm, and "bora winds"when <br /> they are associated with a strong cold frontal passage downslope off the mountains. Precipitation, <br /> which decreases gradually from the eastern border of the state to a minimum near the mountains, <br /> increases rapidly with the increasing elevation of the foothills and proximity to higher ranges. The <br /> decrease in temperature from the eastern boundary of the state westward to the foothills is less than <br /> might be expected with increasing altitude. This results from mountain and valley winds and greater <br /> frequency of the chinook winds. <br /> Due to the proximity to the Rocky Mountains,thunderstorms are quite prevalent in the piedmont <br /> region during the spring and summer. These often become quite severe, and the frequency of hail <br /> events are quite high.
