BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Notice of Violation No. MV-2023-014 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF A POSSIBLE VIOLATION BY MINEWATER LLC, CEASE <br /> AND DESIST ORDER, CORRECTIVE ACTION, AND CIVIL PENALTIES FOR <br /> FAILURE TO OBTAIN A RECLAMATION PERMIT PRIOR TO ENGAGING IN A <br /> NEW MINING OPERATION, File No. M-2023-015 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") <br /> on September 20, 2023, to consider a possible violation by MineWater LLC <br /> ("Operator"), cease and desist order, corrective actions, and a civil penalty for <br /> failure to obtain a reclamation permit before engaging in a new mining operation, <br /> file number M-2023-015. Elliott Russell and Russ Means appeared on behalf of <br /> the Division of Reclamation, Mining and Safety ("Division"). Joseph Harrington <br /> appeared on behalf of Operator. <br /> The Board, having considered presentations, testimony, materials submitted, <br /> and being otherwise fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator filed a 110d permit application for a gold and silver operation <br /> (the "Application") at a site known as the London Mine, located in Section 18, <br /> Township 9 South, Range 78 West, 6th Principal Meridian in Park County, <br /> Colorado. The application is currently under review by the Division and has not <br /> been approved or issued. <br /> 2. The site is a highly disturbed historical mining area with a history of <br /> water quality issues. Operator currently treats water from the site to reduce high <br /> mineral concentrations prior to discharge from the site. <br /> 3. The Application proposes removing waste rock from the historic <br /> tailings and ore stockpiles at the site to be processed by crushing and sorting the <br /> waste rock using an x-ray machine to remove rocks with gold, silver, and other <br /> minerals from the site for processing. Nonmetallic rock will be returned to the site. <br /> This processing should reduce zinc loading in the water that Operator is currently <br /> treating prior to discharge from the site. <br /> 4. The Application includes a plan to build a crushing and sorting facility <br /> on site. <br />
